Part I - General Terms and Conditions

Section 1 – Provider, Inclusion of the Terms and Conditions

(1) The provider and contractual partner for the goods presented in the Etsy shop "Aulinchen" is Anke Rehkämper, Auf der Bleiche 13, 33129 Delbrück, Germany, telephone +49 176 35743413, email Aulinchens-tueddelkram@gmx.de (hereinafter referred to as "Provider").

(2) These terms and conditions are an integral part of every contractual agreement between the Provider and the respective customer. Any conflicting terms and conditions of the customer are hereby rejected.

Section 2 – Product Offer and Conclusion of Contract

(1) By listing an item on Etsy, the Provider makes a binding offer to sell that item. The color representation of the items on the website may vary slightly depending on the internet browser used and the customer's monitor settings; these variations are technically unavoidable.

(2) The customer can accept the seller's offer via the online order form provided by Etsy. To do this, the customer must first place the desired item in the virtual shopping cart on Etsy and then complete the order steps specified by Etsy. By clicking the button that completes the order process, the customer declares acceptance of the offer, thereby concluding a purchase agreement for the goods previously selected by the customer. Until the order is submitted, the customer has the option to correct their entries at any time by going back one or more steps in the browser or to cancel the order entirely.

(3) The contract text is stored by the seller and sent to the customer in text form (e.g., email, fax, or letter) after the contract is concluded, along with these Terms and Conditions and customer information. The seller will not make the contract text available in any other way.

(4) The German language is the only language available for concluding the contract.

(5) The supplier delivers exclusively to customers with a delivery address within Germany.

(6) In the event of delivery obstacles or other circumstances that would prevent fulfillment of the contract, the supplier will inform the customer by email.

Section 3 – Prices and Payment

(1) All product prices are total prices plus shipping costs. These prices include statutory VAT.

(2) Shipping costs are listed in the respective product description.

(3) For deliveries to countries outside the European Union, additional costs may be incurred in individual cases, which are beyond the seller's control and must be borne by the customer. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, exchange rate fees) or import duties and taxes (e.g., customs duties). Such costs may also be incurred with regard to money transfers even if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

(4) The payment option(s) will be communicated to the customer in the seller's offer on Etsy.

(5) The seller offers payment via Etsy Payments. The customer can use the payment methods offered within Etsy Payments.

When using this payment method, payment processing is handled by Etsy Ireland UC,
66/67 Great Strand Street, Dublin 1, Ireland (hereinafter: Etsy UC), unless payment is made in US dollars or Canadian dollars. In this case, payment processing is handled by Etsy Inc., 117 Adams Street, Brooklyn, NY 11201, United States of America (hereinafter: Etsy Inc.).

Etsy UC and Etsy Inc. allow customers to use various payment methods via Etsy Payments, including:
- Credit cards
- Debit/bank cards
- Etsy vouchers and Etsy credits
- PayPal
- Klarna Pay Later (Germany)
- iDEAL (only in the Netherlands)
- Sofort (Austria and Germany)
- Apple Pay
- Android Pay
Etsy UC or Etsy Inc. may use other payment service providers to process payments.

Depending on the item and the customer's location, the aforementioned payment methods may only be available to a limited extent. The specific payment method(s) available for the respective item(s) will be displayed to the customer in the seller's offer or during the order process.

(6) For orders paid in advance, a payment period of one week applies from receipt of the order confirmation. The seller will reserve the ordered item(s) for the customer during this payment period. It is the customer's responsibility to ensure that payment is received by the seller within this period. The seller reserves the right to withdraw from the purchase agreement and sell the item elsewhere if payment is not received by the deadline. Any payment received from the customer after withdrawal will be refunded.

Section 4 – Shipping, Delivery Times

(1) The seller will ship the goods within 3-5 business days of receiving payment.

(2) Unless otherwise agreed, goods will be shipped to the delivery address provided by the customer. The delivery address provided during the Etsy order process is the address used for processing the transaction.

(3) Multiple products ordered simultaneously will be shipped together; the delivery time for the entire shipment will be that of the product with the longest delivery time. If the customer wishes to receive a specific product with a shorter delivery time earlier, they must order that product separately.

(4) If delivery to the customer fails because the customer provided an incorrect or incomplete delivery address, a second delivery attempt will only be made if the customer covers the direct costs of the reshipment. These costs correspond to the shipping costs agreed upon at the time of purchase.

Section 5 – Consumer Right of Withdrawal

(1) A customer who purchases as a consumer has a right of withdrawal in accordance with the statutory provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.

(2) The provider grants a consumer with permanent residence outside of Germany a consumer right of withdrawal in accordance with the German requirements and legal consequences, even if the consumer's national law does not provide for a right of withdrawal or makes withdrawal subject to a shorter period or stricter formalities than under German law.

Section 6 – Warranty (Liability for Defects)

(1) The customer has warranty claims (also known as rights of liability for defects) in accordance with statutory provisions.

(2) The customer is requested to report any delivered goods with obvious transport damage to the delivery service and to inform the supplier. Failure to do so will not affect the customer's statutory or contractual rights regarding defects.

Section 7 – Final Provisions

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). However, German law shall not apply to consumers with permanent residence abroad if the consumer's national law contains provisions from which no contractual derogation to the detriment of the consumer is permitted.

(2) Should any provision of these terms and conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.

Part II - Privacy Policy

(1) Below, I inform you about the type, scope, and purpose of the processing of your personal data when using my Etsy shop. Personal data is any information relating to an identified or identifiable natural person.

(2) The controller within the meaning of the EU General Data Protection Regulation (GDPR) is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data. For personal data processed by the provider of this Etsy shop, the controller within the meaning of the GDPR is: Anke Rehkämper, Auf der Bleiche 13, 33129 Delbrück, Germany, Telephone +49 176 35743413, Email Aulinchens-tueddelkram@gmx.de (hereinafter "I"). (3) When you enter into a contract with me through my Etsy shop, Etsy will transmit your Etsy username, your name, and the billing address as stored in your Etsy user account to me. If you provide additional information as part of your order (e.g., a different delivery address or a telephone number), this information will also be transmitted to me.

(4) I process the data mentioned in paragraph 3 electronically for the proper performance of the contract, in particular for delivery, invoicing, processing payments, and handling returns and complaints. This data processing is based on Article 6(1)(b) GDPR. I retain this data until all mutual claims arising from the respective contractual relationship with you have been fully settled and the statutory retention periods under commercial and tax law to which I am subject have expired.

(5) For a contract to be concluded between you and me, it is necessary that I receive your name, address, and Etsy username. The requirement to provide this data arises, among other things, from Etsy's terms and conditions, as well as from legal regulations (such as Section 312i Paragraph 1 Number 3 of the German Civil Code (BGB), Section 14 Paragraph 4 of the German Value Added Tax Act (UStG)). Without providing this data, you cannot conclude a contract with me.


(5) (6) If I send you physical goods under the purchase agreement, I may transmit your name and shipping address to Deutsche Post (Deutsche Post AG, 53113 Bonn) or DHL (DHL Paket GmbH, 53113 Bonn) as the shipping service provider, for the purpose of delivering the shipment to you and, if necessary, returning your shipment to me, based on Article 6(1)(b) GDPR.

(7) If you use PayPal for payment, the PayPal Privacy Policy also applies to the payment process. PayPal acts on your behalf in this process.

(8) If you send me a message via the "Contact" function on Etsy, Etsy will transmit your Etsy username to me along with your message (legal basis: Article 6(1)(a) GDPR). If you send me a message by email, I will store your message along with the sender's data (name, email address) in order to reply to it and respond to any subsequent follow-up questions from you (legal basis: Article 6(1)(f) GDPR). I use an email provider for receiving, storing, and sending emails, which acts as a data processor for us in accordance with Article 28 GDPR. I will delete the data collected with your message no later than six months after the last communication with you regarding your inquiry, subject to the provision in the following paragraph.

(9) If you send me a legally relevant declaration regarding the contractual relationship (e.g., a cancellation or a complaint), the legal basis for processing, regardless of the transmission method, is also Article 6(1)(b) GDPR. In such a case, I will delete the data associated with your declaration as soon as all mutual claims arising from the contractual relationship have been definitively settled and the commercial and tax-related retention periods have expired.

(10) Social media buttons may be displayed below an article photo; they can be identified by the logos of the social media platforms (hereinafter "platforms") (Facebook: blue "f", Google Plus: red "g+", Pinterest: red "p", Twitter: blue bird silhouette). These are links to the respective platforms, which are based in the USA. Clicking on such a link opens the website of the respective platform, whereby the IP address of the accessing device and the address of the page from which the link originates ("referrer") are transmitted to the accessed platform in the USA. However, we ourselves do not collect or process any data in conn

(12) With regard to the personal data I process about you, you have the following rights:

a) You have the right to request confirmation from me as to whether I process personal data concerning you. If this is the case, I will inform you of the personal data stored about you and the further information pursuant to Article 15(1) and (2) GDPR.

b) You have the right to have inaccurate personal data concerning you rectified without undue delay. Taking into account the purposes of the processing, you also have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

c) You can request that I erase personal data concerning you without undue delay under the conditions of Article 17(1) GDPR, insofar as its processing is not necessary pursuant to Article 17(3) GDPR.

d) You can request that I restrict the processing of your data if one of the conditions of Article 18(1) GDPR applies. In particular, you can request restriction instead of erasure.

e) I will communicate any rectification or erasure of your personal data and any restriction of processing to all recipients to whom I have disclosed your personal data, unless this proves impossible or involves disproportionate effort. I will also inform you about those recipients if you request it.

f) You have the right to receive the personal data you have provided to me in a structured, commonly used, and machine-readable format and may request that I transmit this data to another controller without hindrance, insofar as this is technically feasible.

g) Where data processing is based on your consent, you have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of data processing carried out before your withdrawal.

(13) Right to object: You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you. This right to object applies to processing based on point (f) of Article 6(1) of the GDPR for the purposes of the legitimate interests pursued by me or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data.

If you exercise your right to object, I will no longer process the data in question unless I can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is necessary for the establishment, exercise or defence of legal claims.

(14) If I process personal data for direct marketing purposes (e.g., newsletters), you may object to the processing of your personal data for such marketing purposes at any time, with the result that I will no longer process your data for these purposes.

(15) If you believe that the processing of your personal data infringes the GDPR, you may lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement. This does not preclude other administrative or judicial remedies.

Part III - Cancellation Policy

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise your right of cancellation, you must inform me, Anke Rehkämper, Auf der Bleiche 13, 33129 Delbrück, Germany, telephone +49 176 35743413, email Aulinchens-tueddelkram@gmx.de, of your decision to cancel this contract by an unequivocal statement (e.g. a letter sent by post, fax or email). You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you withdraw from this contract, I will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which I received your notification of withdrawal. For this reimbursement, I will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

I may withhold reimbursement until I have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to me without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to me. The deadline is met if you send back the goods before the period of fourteen days has expired.


You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
